EasyMake123 LLC Terms of Service

1. Definitions

• 'User' : Anyone who accesses or uses the Platform.
• 'Contributor' : Any User who uploads files, designs, models, or other digital content for distribution on the Platform.
• 'Customer' : Any User who downloads or purchases content from the Platform.
• 'Content' : All files, designs, models, text, graphics, or other materials uploaded to the Platform.

2. Eligibility

You must be at least 18 years old to use the Platform. By creating an account, you represent and warrant that you meet this requirement and that all information you provide is truthful and accurate.

3. Account Registration

You may need to register for an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Contributor Terms

4.1 Ownership and Rights

Contributors represent and warrant that:

• They are the sole and exclusive owner of, or have all necessary rights, licenses, and permissions to use and distribute, all Content uploaded to the Platform.
• The Content does not infringe, misappropriate, or violate any intellectual property rights, privacy rights, trade secrets, or other rights of any third party.

4.2 License to EasyMake123

By uploading Content, Contributors grant EasyMake123 a worldwide, non-exclusive, transferable, sublicensable, royalty-bearing license to:

• Host, store, display, reproduce, adapt, format, distribute, and make Content available for download by Customers; and
• Use the Contributor's name and profile information in connection with the marketing and sale of Content.

This license remains in effect until the Content is removed from the Platform, except that licenses granted to Customers who have already downloaded the Content will remain in effect.

4.3 Indemnification (Contributor)

Contributors agree to indemnify, defend, and hold harmless EasyMake123, its owners, affiliates, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Any allegation that their Content infringes or violates any third-party rights;
• Any breach of these Terms; or
• Any misuse of the Platform.

4.4 Compensation and Payment

• Contributors will receive a fee for each download of their Content, based on EasyMake123's pricing and revenue-sharing policies in effect at the time of the download. Payments will be issued every ninety (90) days to the payment account designated by the Contributor, provided the account balance meets the minimum payout threshold set by EasyMake123 of ($1.00 US). This threshold is subject to change.
  
  Contributors are solely responsible for all taxes and reporting obligations related to their earnings.

4.45 Revenue Sharing

• You receive a royalty from each user download of the objects(s) you publish. The current royalty rate as of 11/17/2025 is 0.45 per object (regardless of the number of parts that make up an object). This rate is subject to change.

4.5 Prohibited Content

Contributors are strictly prohibited from uploading, posting, transmitting, or otherwise making available any Content that is pornographic, sexually explicit, obscene, offensive, defamatory, harassing, discriminatory, violent, or otherwise inappropriate, as determined in the sole discretion of EasyMake123.

EasyMake123 reserves the right, but not the obligation, to review, monitor, edit, or remove any Content that violates these standards or that it deems unsuitable for publication on the Platform, without prior notice and without liability to the Contributor. EasyMake123 may also suspend or permanently terminate the account of any Contributor who violates this Section or engages in conduct that, in the judgment of EasyMake123, undermines the integrity, safety, or reputation of the Platform.

Easy make will prohibits, and will remove any products that fall into the following categories. These are considered unsafe, illegal and/or require certifications that are unavailable when 3D printed.

• Firearms or Weapons of any kind.
• Food Containers Without the Right Filament
• Critical Car Parts
• Medical Devices (Without Certification)
• High-Voltage Electrical Components
• Counterfeit Products
• Pressure Vessels
• Structural Furniture
• Currency or Government IDs
• Safety Gear (Like Bike Helmets, Knee Pads, etc.)

5. Customer Terms

Customers may download and use Content subject to any licensing terms displayed at the time of purchase. All sales are final unless otherwise required by law.

6. Prohibited Conduct

• Upload, post, or distribute any unlawful, harmful, defamatory, obscene, infringing, or otherwise objectionable Content;
• Interfere with or disrupt the Platform's functionality;
• Attempt to gain unauthorized access to the Platform or related systems.

7. Intellectual Property of EasyMake123

The Platform, including its design, text, graphics, software, and trademarks, is owned by or licensed to EasyMake123 and is protected by copyright and trademark laws. Users may not copy, distribute, or modify any part of the Platform without prior written consent.

8. Termination

EasyMake123 may suspend or terminate your account or remove Content at its sole discretion, without prior notice, if you violate these Terms or applicable laws.

If you terminate (Delete) your account, your information and published items will be removed from the platform within 24 hours. The items and your information are archived in the event a legal dispute arises over ownership of the items when they were available for download on EasyMake123.

9. Disclaimer of Warranties

The Platform is provided 'as is' and 'as available' without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, EasyMake123 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the Platform.

11. Indemnification by All Users

In addition to Contributor indemnities, all Users agree to indemnify and hold harmless EasyMake123 from claims, damages, or liabilities resulting from their use of the Platform.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New Hampshire, without regard to conflict of law principles. Any disputes will be resolved exclusively in the state or federal courts located in Belknap County, NH.

13. Changes to Terms

EasyMake123 may modify these Terms at any time by posting updated terms on the Platform. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
